USA-TN POLICIES REGARDING PROGRAM COPIES, FOOTAGE USAGE, TRANSCRIPTS, AND UNAUTHORIZED USAGE
All USA Talk Network, Inc. programs and all rights (including but not limited to copyrights) associated with each program are owned solely by USA Talk Network, Inc. (“USA-TN”) and Aaron Harber. Rebroadcast, reproduction, copying, transmission, or conveyance of any program, in whole or in part, is strictly prohibited without the prior written consent of an officer of USA-TN or Aaron Harber.
VHS copies of programs may be obtained by sending payment of $125 per program to USA Talk Network, Inc., 2500 North 119th Street, Lafayette, Colorado 80026-9216 with instructions for delivery. DVD copies are available for $175 per program. These copies are for private viewing, are not for rebroadcast in whole or in part, and are subject to all the restrictions herein. The copies may not be used for viewing by more than 25 people at a time. Otherwise, the broadcast fees, below, apply. Furthermore, there can be no charge for viewing such copies.
At no cost, you may establish a link to the appropriate USA-TN authorized Website where USA-TN programs reside, as long as no changes or modifications are made to the Website housing the programs. Websites authorized by USA-TN include www.HarberTV.com, www.BlindJusticePBS.org, www.TIPAP.org, www.DMEFD.org, and www.KBDI.org.
In the event you wish to use a program or any part of a program for any kind of broadcast purpose (such as in or part of a political advertisement or in any kind of political material), you must obtain prior written permission from USA-TN to license the footage and all of USA-TN’s costs and fees must be pre-paid. There is a flat fee of $500 per request and a separate and additional charge of $100 per second of program for the first 20 consecutive seconds or portion thereof used, $50 per second for the next 20 consecutive seconds, and $25 per second for any time after the first 40 seconds. In the event non-consecutive sections are used, the fee always begins at the $100 per second rate.
In all usage cases, the graphic for “The Aaron Harber Show” or any other USA-TN program (bottom left side of the screen) and the graphic for KBDI-TV Channel 12 (bottom right side of the screen) must be included in the usage. Footage may be used for a period not to exceed twelve (12) months following the original request for footage. All usage rights expire when that time period ends. Any extensions must be negotiated separately. Footage and copies of the program are not assignable or transferable. These are the licensing terms for all footage and the making of a payment by the licensee is considered its agreement to these terms.
In the event you wish to have a transcript of a program, please send your program request, along with payment of $750 to USA-TN and allow 10 to 15 days for delivery of the transcript. The $750 fee applies to each half-hour program. For multiple programs or for programs of greater length, simply apply the rate proportionately (i.e., two half-hour programs or a one-hour program transcript costs $1,500).
All requests must be prepaid. Shipping or delivery is a separate charge and usually is selected by the licensee. USA-TN reserves the unilateral right to accept or reject, without cause, any request for footage, if it believes honoring such a request would be injurious or otherwise detrimental to the best interests of USA-TN. Unauthorized use of any USA-TN program will be prosecuted and damages will be sought at a substantially higher rate (i.e., 100 times) than the above posted rates plus legal fees so please be certain to get written permission from USA-TN before using any footage.
